Wrongful death

Drownings

A drowning is almost never just bad luck. Pools need fences, gates, drains and lifeguards that do their jobs. Boats need sober operators. When someone who was responsible for keeping people safe in the water did not, the family can hold them to account.

What we look into

  • Who was responsible for watching the water, and whether they were trained
  • Fencing, gates, alarms, drain covers and depth markings
  • Whether a boat operator was impaired or reckless
  • Property owner, pool company, apartment complex and city records

Questions families ask

Can we bring a claim if it happened at a friend’s pool?

Often, yes. A homeowner’s insurance policy usually exists for exactly this. The claim is against the policy, not a fight with your friend.

What if no lifeguard was on duty?

That can be part of the claim. Many pools and parks are required to have one, or to post that they do not.
